| 摘 要： | 刑事诉讼中的人权保障问题,在我国具有越来越重要的意义。修改后的刑事诉讼法中,对刑事诉讼制度和司法制度作了重大改革,进一步增强了刑事诉讼的人权保障功能。但几十年来中国的人权保障事业存在着许多缺陷和问题。以人权保障为视角,可以折射出我国刑事诉讼过程中有关制度与观念方面的许多问题,同时也能够对一些争论不休的问题提供一种新的思考方法。

| Abstract: | The protection of the human rights in criminal procedure has become more and more important. In the rectified law of criminal procedure, there are some significant reforms in the institutions of criminal procedure and the judicial institutions, which enhance the protection of human rights. However, there are still many problems in both criminal procedure and people's notion. The article provides some new thinking methods to the problems. |
