从城市房屋公益拆迁到商业拆迁：法律的缺位及其完善

现在我国由城市房屋拆迁引发的纠纷愈来愈多,如何有效地解决这一问题是很多学者和实际工作者所关心的。其实,问题的关键所在在于我国的立法并没有从根本上抓住城市房屋拆迁的目的,而笼统地对待不同性质的房屋拆迁。在城市房屋拆迁中,公益性的拆迁和商业性的拆迁是现实存在的,漠视这一事实便是拆迁纠纷愈演愈烈的根源之一。在立法上,只有把城市房屋商业拆迁从城市房屋拆迁中“剥离”出来另行规范,才能有效遏制层出不穷的拆迁纠纷。

A Jurisprudential Analysis of Urban House Demolition for Public Interests and for Self-interests

There are more and more contradictions in Chinese urban house demolition, which results from the reason that legislation doesn't deal with the demolition for public interests and the demolition for self-interests in different ways. Therefore, for justice, it's necessary for us to distinguish the two types of demolitions in theory and in practice. Only by realizing the importance of the two demolitions can the contradictions be solved well, moreover, our society will develop smoothly.
