| 摘 要： | 法律方法以促进"正当性"判决的获得为目标,而依据解释学及哈贝马斯的真理共识理论,判决的"正当性"来自于相关主体的共识。运用共识理论可以对具体司法过程做出融贯性解释,并可得出诸多具有启发性的结论。

| Abstract: | The aim of the legal method is to get the sentence's justification.And according to the hermeneutic and Habermas' theory of consensus,the justification comes from the consensus among the concerned people.We can get coherent explanation of the judicial process based on the theory of the consensus,and other inspiring conclusions. |
