网络知识产权的刑事法保护

随着知识经济快速成长和信息社会的来临,网络知识产权犯罪日益严重,这主要源于网络知识产权犯罪的犯罪对象具有无形性和易受侵害性,网络知识产权犯罪非营利性的犯罪目的日益彰显,刑事司法管辖难以确定,电子证据十分脆弱,缺乏专门规范侵犯网络知识产权犯罪的法律,刑法典对网络知识产权的保护对象狭窄、罪状设计和刑罚配置不尽合理,刑事诉讼程序设计不完善。要充分保护网络知识产权,必须积极倡导与推进建立国际网络知识产权犯罪的国际司法协助机制,完善我国刑事法的相关规定。

The Criminal Law Protection on Network Intellectual Property Rights

Along with the information society's coming,more serious situations on network intellectual property rights crime are available.The causes are as followings: First,the target of network intellectual property right crime is intangible and apt to be invaded;second,there are more cases of which the offender has nonprofit criminal intent on network intellectual property rights crime;third,it is difficult defining the criminal jurisdiction on network intellectual property rights crime;forth,the electronic evidence is easy to be deleted and amended;fifth,no network intellectual property rights crime act has not been enacted;sixth,there are many flaws in Criminal Code and Criminal Procedure Code.In order to strengthen protection on network intellectual property rights,the framework of international criminal assistance in jurisdiction on network intellectual property rights crime should be established,Criminal Code and Criminal Procedure Code should be amended at the same time.
