可持续发展与环境诉讼的更新

可持续发展观要求法律变革,这种法律变革体现在两个方面,一是环境法的形成和发展,另一是传统法律的生态化。而这两个方面都要求或促成环境诉讼的更新。环境权的公益和私益的交融性,传统诉讼在保护环境方面的不足决定了我们有必要在传统诉讼之外,寻求新的诉讼机制,以实现环境公平。因而建立专门的环境诉讼机制,是环境诉讼更新的目标与要求。

Sustainable Development and the Renovation of the Environmental Lawsuit

The sustainable development view requires the law to reform.The reformation of law is reflected in two aspects: the forming and development of environmental law and the ecological transformation of traditional law.And these two respects both require or facilitate the renovation of the environmental lawsuit.The blending of commonweal and personal profit of environmental right,the shortage of traditional lawsuit determine us to be necessary seek the new lawsuit mechanism outside the traditional lawsuit,in order to realize the environment justice.Therefore to set up special environmental lawsuit mechanism is the goal and requirement that environmental lawsuit turn into.
