行政区划变更基本原则的反思与重构——以《行政区划管理条例》第2条为中心

《行政区划管理条例》第2条所规定的行政区划变更方案制定原则和行政区划总体稳定要求不属于行政区划变更基本原则。一方面,行政区划变更基本原则的规制范围应当涵盖行政区划变更全过程,而非仅针对行政区划变更方案制定这唯一阶段;另一方面,行政区划变更基本原则的主要规制对象应当是动态的行政区划变更行为本身,而非针对静态的行政区划变更结果(行政区划要素)。行政区划变更作为一种公法行为所具有的法定划分、国家控制和权益调整等属性,决定了行政区划变更机制引入权力制约和程序正当等基本法治理念的正当性和必要性。契合法治化需求的适当变更、科学变更、民主变更、公开变更和依法变更等五大原则就应当被确立为行政区划变更基本原则的主要内容。

Reflection and Remodeling of the Basic Principles for Redefining Administrative Regions——Focusing on Article 2 of the Regulations about Division of Administrative Regions

The principles for making plans for specific redefinition of administrative regions and the provisions about stability of division of administrative regions which belong to Article 2 of the Regulations of Division of Administrative Regions are not the basic principles for redefining administrative regions.On the one hand,the scope of the basic principles for redefining administrative regions should cover the entire process of the action,not just the sole stage of making plans for specific redefinition of administrative regions.On the other hand,the most important regulatory object of the basic principles for redefining administrative regions should be the dynamic behavior of redefining itself,rather than the static result of the action(the elements of division of administrative regions).Redefinition of administrative regions as a public law behavior has some attributes,such as statutory division,state control and rights adjustment,which determine the legitimacy and necessity of the basic rule of law concepts.The five basic principles for redefining administrative regions should include appropriateness,science,democracy,transparency,and legality.
