| 摘 要： | 两岸共同打击犯罪,需要尽可能消除两岸罪名差异所带来的不利影响。在合作机制中,两岸刑法的相关规定被纳入到《海峡两岸共同打击犯罪及司法互助协议》的框架内。以抢劫罪为视角探讨罪名差异对两岸合作打击犯罪的影响,提出打击抢劫犯罪的对策:由嫌犯抓获地负责审判,判决所依据的法律为嫌犯之属人法,判决之执行也由属人地司法机关实施。
