罪数论体系检讨

罪数论所处理的问题是对行为人实施的犯罪事实，探讨其所成立的犯罪个数，并作出刑罚效果的认定。在整个刑法体系中，罪数论实为连接犯罪论与刑罚论的桥梁，并将两者统一运用的理论。罪数论建立的前提既有复数规范被实现的场合，又有形似复数规范实则单一规范被实现的场合。其所涉及的犯罪型态，在复数规范的情形，有想象竞合与实质竞合；在单一规范的情形，有法条竞合、结合犯、集合犯、接续犯等。
