试论我国刑法学从论理到注释的发展

长期以来 ,学界对我国刑法学发展轨迹的研究甚少 ,这不能不说是刑法学基础理论研究的一大缺陷。我国刑法学可分为论理刑法学 (主要是刑法哲学 )和注释刑法学 (刑律学 ) ,相应地我国刑法学的发展可划分为论理刑法学发展期和注释刑法学发展期。其中注释刑法学的发展期可进一步划分为两个时期 :一是唐以后 (至于清 )的继续发展期 ,二是 1 979年新中国第一部刑法典颁布后至今的恢复发展期。这样基本梳理了我国刑法学的发展轨迹与过程。

On the Development in the Science of Criminal law from Theoretical Study to Annotation

For a long time, the academic circles in our country have made little research into the development of the science of criminal law, which is a shortcoming in its basic research. To fill in the gaps, the authors point out that China′s science of criminal law can be divided into two parts: theoretical science of criminal law (mainly, philosophy of criminal law) and annotation science of criminal law (science of criminal rules). Correspondingly, the authors divide the development of the science of criminal law into two periods: one is the development period of theoretical science of criminal law, the other is the period of annotation science of criminal law which can be further divided into two parts: one is a period of development from the Tang Dynasty to the Qing Dynasty, the other is the resuming period from the first new-China′s criminal law in 1979 till now. Thus, these are the basic development and process of Chinese science of criminal law.
