| 摘 要： | 侦查阶段证据的收集,是指侦查机关在办理案件过程中依照法定程序,发现、采集、固定证据的诉讼活动,对查明案件事实、正确处理案件、保障人权、维护司法公正具有重要意义。目前理论界和实践界对侦查阶段证据收集的性质还存在一些误解,这也是造成非法取证现象泛滥的重要原因。

| Abstract: | Evidence collection at investigation stage indicates a series activities carried out by the investigation units for discovering,collecting,and keeping evidence pursuant to the provisions.It’s important for finding out the truth,processing a case appropriately,protecing human right and maintaining justice.Now there is some misunderstanding existing in both theory and practice of evidence collection at investigation stage,which is a main reason to explain why illegal evidence collection prevails. |
