平等保护物权的法哲学解读——以拉德布鲁赫的广义正义论为视角

拉德布鲁赫的广义正义论有三个部分组成：平等正义、目的正义和功能正义。与物权的平等保护相对应，平等正义要求从形式上对物权法中各类主体的物权给予平等保护。目的正义要求各类物权主体必须按照市场规律和利益最大化的目标去自由决定以实现市场竞争。而功能正义则要求各类物权主体根据自身的特点，采取针对性的措施克服其自身缺陷，以真正实现物权的平等保护。

The intension reading of the equal protection of property rights on the visual angle of Radbruch's justice theory in broad sense

Radbruch's justice theory in broad sense contains three parts,which are equal justice,order justice and functional justice.With corresponding of the equal protection of property rights,equal justice requests that each property right should be equally protected,but the rule has only formal sense.Order justice requests the property right owners should determine their own things free so as to implement market competition by the virtue of market rules and maximum interest.Functional justice requests the equal protection of property rights could come true by pertinency measures which be made to overcome the deficiency of each property right on the basis of the characteristic of them.
