| 摘 要： | QQ号码具有客观上的可管理可支配性,具有经济价值,属刑法意义上的"财物",可以成为盗窃罪的犯罪对象.盗窃QQ号码转卖牟利的行为构成盗窃罪,同时侵犯他人通信自由,构成侵犯通信自由罪,属想像竞合犯,应从一重罪处罚,定盗窃罪为宜.
