摘    要:优先购买权制度古已有之,改革开放以来,为了维护交易秩序的稳定,促进社会主义市场经济的发展,我国法律对优先购买权制度也作出了相关规定.随着房地产热成为中国社会的重要话题,房屋承租人依法所享有的优先购买权也日益成为民法学所关注的焦点,然而,当前学界对于这一问题的认识尚不够深入,有必要对此做出进一步探讨.

Abstract:The preemption is an old institution in the history.With the reforming and open-up of China,the laws have prescribed the institution of preemption to protect the stabilization of the order of the business and accelerate the economic development.The real property hotness has been an important topic these years,and the preemption of the lessee has been to the focus of the civil law too.However,the legalists don't pay enough attention to the preemption.It is very necessary to do more research on this theme.
