论我国外逃贪官缺席审判制度的构建——以《联合国反腐败公约》资产追回机制为视角

2005年10月27日，我国刑事司法界为了更有效地对境外腐败犯罪进行打击，签订了《联合国反腐败公约》。其中，《联合国反腐败公约》针对将腐败犯罪中的外流财产追回这一情况规定了资产追回机制，这对我国打击贪官携款外逃犯罪提供了依据。然而，由于我国刑事司法并没有设立缺席审判帝】度，使得在适用资产追回机帝】追回外流资产时遇到了障碍。因此，本文针对我国在适用《联合国反腐败公约》资产追回机制打击外逃贪官所面临的困境，在探讨了我国构建缺席审判制度的理论依据和现实基础之后，具体提出构建我国外逃贪官缺席审判制度的设想，以在相关理论研究中起到抛砖引玉之功效。

Constructing the System of Trial by Default to Corrupt Officials of Our Country——Proceed from the Mechanism of Assets Back of 〈 The United Nations Convention against Corruption

Our criminal judicial in order to fight against？ corruption crime, has signed the 〈 The United Nations convention against corruption：〉 since October 27, 2005. At the same time, the 〈The United Nations convention against corruption〉 has stipulated the mechanism of Assets back, and it provided the basis for the activities of fighting against？ corrupt officials carrying the loot and escaping to overseas. However, because there is not trial by defaulting system in our country criminal justice, there are some difficulties in applying the mechanism of Assets back. Above all, this paper according to the satiation of the difficulties in ap- plying the mechanism of Assets back, after exploring the theoretical basis of the judicial system and realistic basis of the trial by de- faulting system, wants to bring forward the idea of how to build the trial by defaulting system, so as to play a valuable in relevant theories.
