| 摘 要： | 文章先是对我国现行刑事诉讼制度中有关被害人与被告人的人权保障的设计和规范进行分析;而后针对我国现行刑事诉讼中被害人与被告人的人权保障方面存在的问题,从有利于被害人与被告人人权保护的角度,提出一些意见。
