无固定期限劳动合同订立条件的立法缺陷

摘    要:为了保护劳动者的合法权益、稳定劳动关系,我国《劳动合同法》增强了无固定期限劳动合同的强制性,这弥补了先前《劳动法》的不足。但是,在无固定期限劳动合同的订立条件上,《劳动合同法》对特殊情形中的无固定期限劳动合同作出了不同的要求,但这些要求都在一定程度上表现出了不严谨性。

Abstract:In order to protect laborer's rights and to stabilize the labor relationship,the Labor Contract Law of China stipulates mandatory flexible-term labor contract which remedy the defect of Labor Law of China.However,the Law makes different demands for different contract on its concluding conditions which to the extent that embodies improper features of the legislature.
