| 摘 要： | 离婚损害赔偿是我国 2 0 0 1年 4月 2 8日对婚姻法进行修订后所增补的一项新的内容。本文首先对这一责任的性质作了分析 ,认为离婚损害赔偿责任是建立在侵权责任基础之上的。然后 ,又在侵权责任构成腰间的基础之上对这一责任的构成要件进行了分析。除了侵权责任的一般构成要件的要求之外 ,离婚损害赔偿责任的构成要件还包括了赔偿责任主体、赔偿责任的启动要件等特殊的规定
