| 摘 要： | 对具有牵连关系的自诉案件与公诉案件是合并审理还是分立审理,应确立一个判断标准。这一判断标准包含自诉案件与公诉案件所涉及的实体法律关系是否同一,主体是否单一,公诉案件与自诉案件的处理时间、空间是否一致等内容。
