对《公安机关办理行政案件程序规定》的理解和适用

为了贯彻《中华人民共和国治安处罚法》，进一步规范公安机关办理行政案件程序规定，在总结执法实践经验的基础上，公安部对2003年制定颁布的《公安机关办理行政案件程序规定》进行了修改、完善。修订后的《公安机关办理行政案件程序规定》已于2006年8月28日以公安部88号令颁布施行。《公安机关办理行政案件程序规定》对维护法制的统一，规范执法行为，促进执法公正，保障公安机关依法履行职责．保护公民、法人和其他组织的合法权益具有十分重要的意义．

The Understanding and Application of Some Issues in "Procedural Rules of Public Security Organ's Handling Administrative Cases"

In order to implement the "Law of the People's Republic of China on Punishments in Public Order and Security Administration" and further standardize the procedural rules of public security organ's handling administrative cases, on the basis of summing up experiences in law enforcement, the Ministry of Public Security revised and perfected the "Procedural Rules of Public Security Organ's Handling Administrative Cases" formulated in 2003. The revised "Procedural Rules of Public Security Organ's Handling Administrative Cases" was promulgated on August 28, 2006 by the Ministry of Public Security and its promulgation was of great significance in maintaining unified legal system, standardizing law enforcement acts, promoting impartial law enforcement, safeguarding public security organ's legal duty fulfillment, protecting the legitimate rights and interests of citizens, legal persons and other organizations.
