| 摘 要： | 危险驾驶行为具有严重的社会危害性,现行法律对危险驾驶的立法规定不足,交通肇事罪与以危险方法危害公共安全罪无法正确评价该行为,有必要对危险驾驶行为进行准确地界定,在刑法中单独增设危险驾驶罪,将酒后驾驶、飙车等危险驾驶行为纳入刑法规制范围,作为交通肇事罪和以危险方法危害公共安全罪之间的过渡性罪名。

| Abstract: | The behavior of dangerous driving has serious social harmfulness, and the legislation regulation of dangerous driving in current law is deficient. Crime of causing traffic casualties and crime of intentionally endangering public security by using other dangerous means can＇ t aecurately evaluate the behavior; so it is necessary to precisely define the behavior of dangerous driving, add ＂crime of dangerous driving＂ in Criminal Lawof P.R.China, and bring dangerous driving behavior, such as driving after drinking alcohol and drag-racing, into the range regulated by Criminal Law as the transitional crime between Crime of causing traffic casualties and crime of intentionally endangering public security by using other dangerous means. |
