以集体土地产权为视角分析我国土地征收制度

土地征收,是指国家根据公共利益的需要，以补偿为条件而强制取得他人所有的土地制度。我国不存在私人土地所有权，土地征收唯一的对象是集体所有的土地。当前，随着我国工业化和城镇化进程的加快，土地征收规模不断扩大，存在的问题集中表现在侵害集体土地所有权和农民的土地承包经营权上。解决问题的方案有：通过立法明确集体土地所有权代表、将土地承包经营权纳入征收客体和补偿范围，以公益诉讼保护集体土地合法权益等，
