摘    要:《中华人民共和国劳动争议调解仲裁法》是新中国第一部专门的劳动争议处理的程序性法律;谈法虽然在一些制度设计上有重大交破。但仍存在不少缺陷,主要表现为:法律确立的着重调解原则并非理性化选择;企业调解制度设计存在缺陷;对劳动者进行倾斜保护的支付令制度存在法律冲突;劳动争议仲裁的行政本位思想依然浓厚;程序之间关联性缺失等。因此,对劳动争议处理制度有继续探讨的必要,从而使我国劳动法制更加完善。

Abstract:Labor Dispute Mediation and Arbitration Law is the first special procedural law to deal with labor dispute. The law has major breakthrough in system design, but is also has some defects, thai is, the emphasized mediation principle established by law is not rational chuice: the mediation system design of enterprise tins defects; the payment order system inclined to protect laborer has legal conflict; the administration- oriented ideas of labor dispute mediation is still dense: the procedures laek correlation and etc, so it is necessary to discuss the labor dispute management system to perfect our nation's labor law.
