劳动争议处理制度改造思考

摘    要:劳动争议处理制度是劳动法确立的一项重要程序制度,是调整劳动关系的法律机制之一。但我国现行劳动争议处理制度模式却颇遭诟病,新颁布的《劳动争议调解仲裁法》确立的相关制度也存在缺陷,所以,需要进行制度重构:一是应坚持平等公正、成本合理化、有效化解矛盾与构建和谐稳定劳动关系的争议处理价值取向;二是处理个人争议与集体争议、权利争议与利益争议、侵权争议与合同争议应适用不同方式;三是取消劳动争议调解委员会的调解,坚持"三方原则",转移调解重心,实行自愿与强制相结合的调解制度;四是淡化劳动争议仲裁的行政属性以增强民间性,简化仲裁程序以提高争议处理效率,裁审实现分离,正确发挥仲裁功能;五是改造劳动争议审判组织及劳动争议诉讼程序机制,合理确定劳动争议诉讼的主管范围,从而构建科学、合理的劳动争议处理制度。

Abstract:The labor dispute settlement system is an important procedural system established by Labor Law and one of the legal mechanisms adjusting the labor relationships.However,the present system pattern of labor dispute settlement meets disapproval and the relevant systems established by the new promulgated Mediation & Arbitration Law for Labor Dispute have defects.So the system reconstruction is necessary:Firstly,equality,justness,cost rationalization,defusing contradiction effectively and value orientation of settling dispute to construct harmonious and steady labor relationship should be upheld;Secondly,different ways should be applied in settling individual and collective dispute,right and interest dispute,infringement and contract dispute;Thirdly,the labor disputes reconcile committee should be canceled,tripartite principle should be upheld,the mediation focus should be transformed by implementing the mediation system of combining voluntary and enforcement;Fourthly,folk character should be strengthened by playing down administrative attribute in labor dispute arbitration,dispute settlement efficiency should be improved by simplifying arbitration procedures,and separation of arbitration and judicial decision should be realized to exert the role of arbitration;Fifthly,to construct scientific and rational labor dispute settlement system,labor dispute trial organization and labor dispute litigation procedure mechanism need to be reformed,and main managing range of labor dispute litigation need to be rationally defined.
