侦查讯问的理念转变及制度建构

鉴于我国侦查讯问在立法和司法实践中存在的一些问题,侦查讯问在理念上应当有所转变:从有罪推定向无罪推定转变,从口供中心主义向物证中心主义转变,从打击犯罪向保障人权转变。同时,赋予犯罪嫌疑人沉默权,讯问时律师在场权,建立同步录音录像和举证责任倒置制度,确立非法证据排除规则,从制度上保证侦查讯问的合法性。

Concept Transformation and System Construction of Investigative Interrogation

Owing to the problems existed in China's investigative interrogation and the judicial practice,the theory of investigative interrogation should be changed from presumption of guilt to presumption of innocence,from confession centered doctrine to material evidence centered doctrine and from attacking crime to protecting human rights.Meanwhile,it can ensure the legitimacy of investigative interrogation based on system to endow the criminal suspects with right to silence and lawyer presence right during interrogation,to construct the system of synchronous sound and video recording and the reverse of proving obligation,and to establish exclusionary rule of evidence illegally obtained.
