| 摘 要： | 现代侦查权是一种法治化的权力。法治,以其强大的意识和制度力量,塑造了现代侦查权的基本面目。反思我国现行侦查制度,侦查法治化依然任重道远。我国侦查权的重构,在法治的视野下,可以从弥散与整合、分权与制衡、规则与裁量、正当与有效等四个方面来进行。
