2000年依法治军理论与实践学术研讨会综述

研讨会的观点集中体现为毛泽东、邓小平、江泽民三代领导核心关于依法治军的理论与实践,具有时代的先进性、历史的继承性和发展的阶段性;关于依法治军的理论问题,必须弄清依法治军的基本概念和内涵、功能和理念、目标和重点等;依法治军的实践涉及国防和军队建设的方方面面,要着力解决依法管理、依法做好军队思想政治工作、依法维护国家军事利益和官兵的合法权益、建立严格有效的监督机制、开展法制教育、培养依法治军人才等方面的问题;对于我国古代及西方发达国家在"依法治军"中的先进的、有益的经验,我们应根据我军实情学习、借鉴之;我们还必须认真研究国际法,切实维护国家主权.

A Summary of 2000-year Academic Discussing Meeting on Theories and Practice of Governing the Army according to Law

Some of the opinions raised during the discussing meeting go as following :the theories and practice established by the three generation leading core bear the features as the advancedness of the times ,historic inheritance ,and developing periodicness ;concerned about the theoretical problems of governing the army according to law ,its basic concept ,its intension ,function,ideal targets and emphasis should be defined first;the practice of governing the army according to law connects lots of aspects with national defence and army construction,more attention should be paid to the management according to law ,to the ideological and political work according to law ,to the protection of the servicemen's legal rights and interests and of national military interests according to law .Some useful and helpful experience of governing the army according to law drawn from ancient China and Western developed countries should be learned with concerns of our army's reality .
