论习惯法在民事审判中的适用

习惯法在我国源远流长。广阔的生活领域中，总有着制定法无法顾及到的方面，而在这些方面总有着习惯法无处不在的身影，正是依靠它，人们才秩序井然地生活着。忽视和排斥习惯法的作用对民事审判工作会造成不利的影响。民事审判活动中适用习惯法，既有法学理论上的根据，又有世界各国不同历史时期成功的司法实例相佐证。为提高民事审判工作效率，应视具体情况恰当适用习惯法，推动民事审判方式的改革

On Application of Customary Law in Civil Justice

Customary law (CL.) in our nation goes back to ancient times. In people's broad daily lives, there are always the phenomena of CL. application, for which statutes may not be suitable. It is under the application of CL. that people keep a good living order. The neglect and repudiation of CL. may have adverse effects on civil trial. Application of CL. in civil trial has both the legal grounds and the successful precedents in different periods of all countries in the world. Based on facts, CL. should be correctly applied in order to enhance the efficiency and enforce the reform of civil justice.
