| 摘 要： | 目前理论和立法所使用的行政处分概念比较混乱,需要加以澄清和规范.行政处分的当事人应当限于行政机关及其工作人员;行政处分与政纪处分既有联系又有区别,行政处分必须以违法行政为前提,是违法行政所导致的一种法律责任.

| Abstract: | Presently,there is confusion of the concept of administrative punishment on theory and legis- lation.Therefore such concept needs for clarification and normalizaton.The party of administrative pun- ishment should be limited to the administrative organization and its personnel.Administrative punishment and discipline punishment are related,as well as differentiated.The illegal administration must be the premise of the administrative punishment,and it will result in a sort of legal responsibility. |
