| 摘 要： | 国际能源合作开发争端是现代国际法晚近出现的新问题,其涉及的主体众多,选择的方式广泛,适用的法律多样。传统解决方式诸如调停、仲裁等国际争端解决方式显露出它的局限性,《能源宪章条约》中的解决机制为国际能源合作开发的争端解决提供了新的思路。另外,美国晚近发展的替代性争端解决机制(ADR)也为能源合作开发的争端解决开辟了新的道路。

| Abstract: | The international energy co-operative development dispute is new to modern international law.It involves many subjects,has a variety of choices and applies to a number of laws.The traditional dispute settlement mechanisms,such as mediation,arbitration and etc.are of great limitation.The dispute settlement mechanism in The Energy Charter Treaty offers a new idea for the energy co-operative development dispute.In addition,the Alternative Dispute Resolution(ADR) also provides a new path for it. |
