| 摘 要： | 《国家赔偿法》所构建的赔偿义务机关制度尚存在许多问题。其中,《国家赔偿法》第八条的规定,混淆了复议机关与最初造成侵权行为的行政机关的责任界限,不利于复议机关更好地履行复议义务。所以,应修改《国家赔偿法》第八条规定,对《国家赔偿法》第八条的修改应以公正、方便赔偿受害人请求以及法院审理赔偿案件为基本点,对此,文章提出了相应的修改建议。

| Abstract: | The organ for compensatory obligations system constructed by the Chinese State Compensation Law has some deficiencies.Confusing responsibility line between the organ under compensatory obligations and the organ for reconsideration,results in the organ for reconsiderations not exercising their functions and powers very well,according to article 8 of the Chinese State Compensation Law.Article 8 of the Chinese State Compensation Law has to be revised more just and convenient to the aggrieved person having the right to recover damages and to the court hearing the cases.The author proposes his suggestions in revising this law. |
