一个社会对危机的处理是其法治程度的试金石.在危机时期公共权力急剧膨胀,人民权利受到各种各样限制甚至剥夺,权力与权利的冲突扩大.如何保证政府有充足权力处置危机,保证政府法治本质不因危机而变色,正是本文之初衷.本文在借鉴国外处置危机成熟法制经验的基础上,论述了我国制定紧急状态法的必要性,并对我国紧急状态法的法律体系、内容进行了初步构思.

SARS and Legal System--Reflection on Enacting Emergency State Law

The ablity to handle crisis is the touchstone of a society's legal system.During the crisis time,the public power grows immensely while the civil rights are restricted variously even deprived,hence the conflict between authority and civil rights is enlarged.This paper deals with how to handle crisis and how to keep the essence of ruling by law in crisis time.Using the mature legal experence of other countries' handling crisis as reference, the paper suggests enact the Emergency State Law in China,it also puts forward some elementary proposal on the legal system and main substance under the Emergency State Law .
