| 摘 要： | 证人当庭翻证的情形有三种,即否定庭前真实陈述的翻证、否定庭前误述的翻证和否定庭前故意虚假陈述的翻证。以此为基础,根据证据能力和证明力的要求,证人翻证后与当庭陈述相矛盾的庭前陈述在一定的条件可分别作为独立证据和弹劾证据使用。对证人伪证罪之追究,必须从保障证人和被告人权益的角度充分考虑其追究的特殊性,从程序上进行特别的规定以使其符合程序正当性的基本要求。

| Abstract: | The three types of the witness changing testimony in the court includes ch anges testimony of denying true state,error state,and intentional false state before the c ourt.When the witness changes tes-timony,testimony of out of the court which contradicts testimony in the c ourt can be used separately by the independence evidence or impeachme nt evidence if some conditions are me t.It is necessary to abide by the special procedure when the witness i s prosecuted owing to witness changing testimony. |
