侦查辨认实施问题研究

2013年1月1日实施的新刑事诉讼法第一次将辨认笔录纳入了证据的行列，表明辨认在侦查破案和确定犯罪嫌疑人方面具有重要作用，但在辨认操作中还存在有不少的难点与问题，造成侦查辨认错误或瑕疵。从侦查辨认在实施中的主要问题及成因、侦查辨认在实施中应遵守的规则与要求、侦查辨认程序的启动与实施、对侦查辨认结论的审查等方面进行阐述，力争使侦查辨认科学、统一和规范，防止出现错案或瑕疵证据。

Research on the Problem of Implementation of Investigative Identification

According to the new Criminal Procedure Law enforced on January 1 st, 2013, identification record is included in the scope of evidence for the first time, indicating that identification plays an important role in in- vestigating and solving the case and identifying suspects. However, there are many difficulties and problems in the operation of inw~stigation, causing the error or defect of investigative identification. The author states how to implement the investigative identification from the aspects of the main problem and its reason of investigative i- de~tification during the implementation, the rules and requirements of investigative identification during the implementation, the activation and implementation of the procedure of investigative identification, and the ex- amination of the conclusion of investigative identification and so on, trying to make the investigative identifica- tion scientific, unified and regularized and avoid the occurrence of misjudged cases or defective evidence.
