| 摘 要： | 《刑法修正案（八）》对老年人犯罪采取了从宽处罚措施，使我国在老年人犯罪刑事责任上得到进一步完善，其修改内容与现代刑法理念相契合，有利于宽严相济刑事政策的落实。应以此为契机，在今后立法中增加排除老年人累犯、降低死刑适用限制的年龄起点、废除老年人犯罪不适用死刑的例外以及分段设定老年人犯罪的刑事责任年龄的规定，使老年人犯罪的刑事责任立法更加完善。

| Abstract: | Criminal Law Amendment （8） has taken a lenient punishment measures for the elderly crime so that the elderly criminal responsibility has been further improved in China. The amendment content fits with the modern conception of criminal law and in favor of the lenient and strict criminal policy implementation. We should take this as an opportunity in the future legislation for excluding the elderly recidivism, reducing the starting point of the age limit for application of death penalty, abolishing the exception of the elderly crime be- ing inapplicable for the death penalty and setting age in segment for the elderly criminal responsibility, so that the elderly criminal responsibility for crimes legislation can become more perfect. |
