论我国刑事强制性措施的完善

刑事强制性措施是指囊括我国现行《刑事诉讼法》第一编总则中的“强制措施”和第二编“侦查”一章中的扣押、搜查等强制性侦查措施的总称。文章认为：我国现行法律中对刑事强制措施和强制性侦查措施的定性模糊，没有形成完整规范的刑事强制性措施体系，应从完善立法和规范执法两个层面入手，把我国的刑事强制措施和强制性侦查措施纳入法制化的轨道，保证国家公权力对公民所享有的宪法基本权利的限制与剥夺受到最严格的制约和监督，实现惩治犯罪和保护人权的双重效果。

On the Improvement of Criminal Coercive Measures

This article refers to the alleged criminal coercive measures include China＇s current ＂Code of Criminal Procedure,＂ General Part of ＂Coercive measures＂ and Part II ＂Investigation＂ is a chapter in the arrest and searches the general term for compulsory investigative measures . The authors argue that： in our country＇s laws on criminal coercive measures and mandatory measures for the qualitative detection of ambiguity, there is no standard forming a complete system of criminal coercive measures, while there is lacking the applicable principles. The operability is not strong system design flaws practice prone to violations of citizens rights.
