| 摘 要： | 刑事证据规则具有司法功能，我国目前的刑事证据规则缺乏证据规则体系，缺少证据资格限制，规定比较粗疏，有的规定甚至互相抵触。从传闻证据规则、非法证据排除规则、口供补强规则、禁止诱导性询问规则与证据开示规则等方面探讨了完善我国刑事证据规则的方法。

| Abstract: | The authors sum up the judicial function of criminal evidence and analyze the present situation of domestic rules of criminal evidence. That is absence of the system construction of criminal evidence, lack of the limit to evidential qualification, imprecise rules and inter-contradiction of some rules, and so on. In the article they explain some principles on improving rules of criminal evidence, such as： pattern of litigation suited to our law, making up deficiencies in proof, achieving maximum benefit in litigation. They discuss the key points and measures to improve rules of criminal evidence, including rule of hearsay evidence, rule of eliminating illegal evidence, rule of confession-supplied-strong, rule of prohibiting inductive inquiry and system of criminal evidence discovery. |
