未成年犯社区矫正中的检察研究——以《刑法修正案（八）》为视角

《刑法修正案（八）》中有关社区矫正的规定,从法律意义上肯定了社区矫正在我国试行的成功经验。但是,随着未成年犯社区矫正工作的全面推行,一些深层次问题也暴露出来。检察机关对未成年犯社区矫正的法律监督所遇到的法律依据欠缺、缺乏介入机制等问题与上述深层次问题紧密相联,严重制约了未成年犯社区矫正工作的完善。通过一系列措施完善检察机关对未成年犯社区矫正的法律监督对推动未成年犯社区矫正工作的有效开展和完善社区矫正立法具有重要作用。
