| 摘 要： | 批捕权配置是司法改革争议的焦点问题,主要表现在批捕权与检察权关系的分歧、批捕权配置的科学性之间的冲突、批捕权配置的科学性与现实性的冲突等方面。影响批捕权配置包括多方面的因素,不仅要考虑科学性问题,还要考虑司法改革的社会历史因素(非理性);同时司法改革不能仅从一个局部去修修补补,而要从整体上进行革命性的改革。

| Abstract: | The configuration of arrest approval power is one of the focuses of judicial reform. Its conflicts mainly shows the relations between the power of arrest approval and that of prosecution , the scienticalness and realisticalness of the configuration of the power. There are many facts which affects the power of arrest approval , includg the scienticalness , historical facts of judicial reform and so on. Meanwhile, judicial reform is not to be amendented partly but to reform completely. |
