诱惑侦查的界定

诱惑侦查作为侦查中一种特殊的侦查手段,目前在我国尚无明文规定,但在司法实践中却频频使用,并由此引发了诸多法律问题,因而实践中有必要对诱惑侦查构成要素,即诱惑侦查主体、内容以及客体三方面重新进行认定,重构诱惑侦查,以使诱惑侦查在实践操作中更具规范性、正当性,并为其立法构建提供合理的依据。
