论侦讯对话的任意性与强制性

侦讯是一种法律性对话，具有一定的强制性。侦讯对话的强制性有内在的强制性和外在的强制性之分。内在强制性是意识到法律制裁而带来的心理压力，它强制的是当事人的内心。外在强制性是对当事者人身自由的限制，它们都需建立在证据的基石之上。侦讯也具有任意性。在侦讯中，法律强制性是绝对的，人道任意性是相对的，有对策条件的，任意性存在于强制性之中。

On Randomicity and Mandatory in Interrogation

Interrogation is a legal dialogue,which is certainly mandatory.The mandatory of investigation dialogue is divided into two parts：internal and external mandatory.Internal mandatory is the psychological pressure caused by sensing the legal sanctions,which forced the party＇s heart; external mandatory is the restrictions of personal freedom of the party.Both of them are constructed on the foundation of evidence. Investigation is also randomicity. In the interrogation,the law mandatory is absolutely,and humanity randomicity is relatively and conditionally.Randomicity is present in mandatory.
