构建我国刑事非法证据排除规则——以《中华人民共和国刑事诉讼法修正案(草案)》为契机

我国2010年公布的《关于办理刑事案件排除非法证据的规定》和2011年8月公布的《中华人民共和国刑事诉讼法修正案(草案)》基本确定了我国非法证据排除规则.此规定与我国司法实践的要求还有一段距离,和西方法治国家的先进制度还有一定差距.如我国法律规定的非法获取言词证据的手段过于简单、缺乏对搜查扣押的司法监督措施、律师介入侦查阶段监督非法取证行为的障碍重重.为构建我国刑事非法证据排除规则,应将“不得强迫自证其罪”中的“强迫”列入非法获取言词证据的手段,由检察机关签发搜查令和扣押令,在易发生非法取证的侦查阶段引入律师介入程序

Set up Excluding Rule of Illegal Proofs in Criminal Cases——Taking Revision Bill of Criminal Lawsuit Law of The People’s Republic of China(drafted plan) as A Chance

Provisions on Excluding Illegal Proofs in Criminal Cases issued in 2010 and Revision Bill of Criminal Lawsuit Law of The People’s Republic of China(drafted plan) in Aug.2011 set up the rules on excluding illegal proofs.But there is still a distance between these rules and judicial practice,and a margin between them and advanced systems in western countries.Such as,too simple means to illegally obtain spoken proofs,lack of legal surveillance on inspect and distrain measures,obstacles on lawyers’,being involved in investigating illegal evidence behavior etc..Comparing the related laws in China with American’s,This paper puts forward some suggestions,such as in "Don’t force the suspects to prove their own offenses","force" be in the illegal means.;the procurator organizations issue the search and detention orders;the lawyers should get involved in investigation process in stages where illegal proofs easily occur.
