| 摘 要： | 我国现行法律明确规定,公民、法人或者其他组织认为具体行政行为侵犯其合法权益,有权提起复议或诉讼.但是,如果行政机关违法行使职权侵犯了公民的非法利益,那么这种非法利益是得不到保护的.行政违法必受追究,行政机关侵犯公民非法利益应纳入诉讼.
