| 摘 要： | "以人为本"是法律发展的价值核心,其在推动科学发展、促进社会和谐、全面建设小康社会的语境下再被赋予新的内涵,应从一般层面与具体层面对"以人为本"的内涵进行法哲学解读;同时,和谐社会中"以人为本"的法律发展应以"观念培育 制度构筑 实践贯彻"作为其实现的路径。从法哲学的角度阐释"以人为本",其意义就在于尝试廓清"以人为本"在和谐社会语境下的含义,以确立科学的法律发展观,推动我国的法治实践。
