| 摘 要： | 卢曼的社会系统论是对现代社会进行分析的理论产物,其理论根源是自然科学系统论。而作为卢曼社会系统理论核心的自我生产与自我参照概念,在合同制度中有着明显的体现。从系统的开放性与封闭性两个方面,以系统论的角度分析合同制度系统中的两个制度。
