组织未成年人进行违反治安管理活动罪若干问题探析——以《刑法修正案(七)》为背景

为扭转实务部门在打击组织未成年人进行违反治安管理活动行为的被动格局,保护未成年人的合法权利,《刑法修正案(七)》将该行为犯罪化。在本罪构成特征中,其客体为复杂客体,主要客体是未成年人保护制度,次要客体为社会治安管理制度;在其客观特征中,被组织者实施的行为原则上应当限于侵犯财产权且不属于《治安管理处罚法》规定的情节较轻的违反治安管理的行为。在司法认定中,需要注意区分本罪与相关犯罪的间接正犯以及与本罪相类似的某些聚众类犯罪和其他组织型犯罪。
