试论我国消费者权益保护法的完善

文章论述了对我国消费者保护法律体系的完善,明晰了消费者的概念:消费者是指非为营利目的购买商品或接受服务的个人,且不以支付对价为要件,明确了消费者保护法的调整范围:消费者权益保护法主要调整为生活消费需要购买、使用商品或者接受服务而产生的关系,或者说是一种生活消费关系。对权利救济制度进行了完善,包括完善损害赔偿制度、建立消费者保护公益诉讼制度等。

On the Perfection to the Law of Consumer Rights Protection

In order to improve the legal system of consumer protection,this article focuses on the following three aspects: Firstly,defines the concept of "consumers";According to the author's view,consumers under the consumer protection law are individuals who purchase commodities or receive service not for profit,and paying consideration is not the constitutive requirement.Secondly,clears the adjustment object of consumer protection law.The author suggests that consumer protection law adjusts social relationships produced by purchasing and using commodities or receiving service,i.e.life consumption relationship.Thirdly,concludes some improvements on the right remedy system,including perfecting damage compensation system,establishing consumer protection public interest litigation system,etc.
