和谐社会秩序建构中的农民社会保障权

保护农民社会保障权既是落实宪法赋予的公民平等权的必然要求,也是统筹城乡发展构建和谐社会的应有之义,更是促进农民主体性发展的基本保障。然而,包括农民养老保险在内的农民社会保障权保护存在严重阙失,原因主要是二元体制的恶果。以和谐和发展为视角对农民社会保障权进行审视,完善立法、组织保障,强化法律救济,加强政府责任意识和农民维权意识当是必然选择。

To protect social security right of peasants' is not only a inevitable request to implement the equal right of citizen which is endowed by constitution,but also a intrinsic meaning to plan the development of urban and rural as a whole,and to construct the harmonious society.What is more,it is a basic security to promote the subjective development of peasants.However,the social security right including peasants' old-age insurance is shortcoming.It is mainly the evil result of dual system.scrutinizing the social security of peasant from the harmony and developing angle,it is inevitable choice to perfect legislation,to strengthen organization security and legal remedy,and to enhance duty consciousness of government and right consciousness of protecting right of peasants.
