| 摘 要： | 从价值观意义而言,刑法具有保护以及保障这两大机能,二者在刑法体系中既相互统一又长期冲突。将其置于更广阔社会维度内进行考察,通过刑事一体化的思维来协调二者之间的关系,是解决二者矛盾、冲突的有效途径。参照我国传统法律文化、当今社会犯罪态势以及监狱行刑效能,结合现代刑法理论,能够对我国刑法机能的定位做出更加理性的选择。
