关于制定中国民法典的几点思考

民法的基本理念是意志自由 ,它应体现在民法内容中而非民法典体例上 ;民法典的体例设计应充分考虑到本土法律传统和法律内在的逻辑性 ;我国民法典的体例应为总则、人身关系法、继承法、物权法、债法五部分按序排列构成 ;人格权不应单独成编 ,而应与亲属法组成人身关系法 ;侵权行为法不应从债法中分离。

Reflections on the Future Chinese Civil Code

The idea of the civil law is the freedom of will.The contents of civil code would be the embodiment of the ideas of the civil law.We should fully consider the tradition of our law system and the logicality of civil law when we design the structure of the future Chinese civil code.The structure sequence of future Chinese civil code is gen eral principles,persion and relation law ,inheritance law,property law ,obligation law.Personality law Shouldn't become an individual division.Tort law shouldn't separate from obligation law.
