| 摘 要： | 依据《劳动法》、《劳动保障监察条例》建立的劳动保障一般监察模式在为劳动者维护权利和推进社会保障事业工作中取得了显著成效,但在构建和谐社会新要求下凸显其立法缺陷和实践困惑。和谐监察模式是一般监察模式的演化体,基本框架内容可以概括为:"六个模块程序结构"、"三个协同配合"、"一个本质性目标"。和谐监察模式在局部区域的成功实践证明其具有典型示范意义。应完善立法,重新修订现有劳动法律法规,制订监察程序规则,加速和谐监察模式在全国的确立和推广。
